Making Permanent EB-5 Program and Improvements to EB-5 Job Counting Method
In his plan to making the EB-5 pilot program permanent Sen. Patrick Leahy, D-Vt.is proposing a list of improvements focused on stronger staffing, streamlining the review process for applications and business plans, better reporting, and defining the what full time employment as it pertains to the EB-5 job requirements. Full-time employment is currently defined as 35 total hours a week, per year, per employee (approximately 1,750 hours per year). Sen. Leahy’s proposal would count 1,750 hours worked as a full-time position towards the EB-5 job requirement regardless if the work is done by a single person or multiple individuals.An EB-5 investors investment must create 10 permanent full time jobs for American workers in order to qualify for a Untied States Green Card.

EPR Properties (“EPR”) (EPR), together with Empire Resorts, Inc. and its wholly owned subsidiary, Monticello Raceway Management, Inc. (together “Empire”) (NYNY) last night received approval from the Town of Thompson Town Board on the Comprehensive Development Plan (“CDP”), SEQRA findings and the Planned Resort Development Text Amendments (“Amendments”) for the 1,583-acre site of the former Concord Resort (“EPT Concord Resort”). Approval of the CDP and SEQRA findings and the adoption of the Amendments means the joint developments can now move forward with the submission of individual site plan applications, thus initiating the commencement of the build-out of the proposed EPT Concord Resort.

Rock Hill Town Center: Concord Resort and Casino - A new approach. A new opportunity.
The site sits directly off
of Interstate 86 Exit 106 and is less than4 miles from Rock Hill Town
Center. This project is a joint venture of Empire Resorts, Inc., which is
controlled by the Genting Group of Malaysia, and Entertainment Property Trust,
which is a $2.9 billion real estate investment trust. Genting Group is one of
the largest conglomerates in Asia with holdings in excess of $40 billion.
It is also one of the top gaming and casino operators in Asia (Resorts World)
and was the original financial backer of Foxwoods Casino in Connecticut.

What is the USCIS EB-5 Immigration Investor program?

The USCIS administers the Immigrant Investor Program, also known as “EB-5” or
"Employment-Based Immigration: Fifth Preference ," created by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors in U.S. business ventures. Under a pilot immigration program first enacted in 1992 and recently extended another three years into 2015, certain EB-5 visas also are set aside for investors in Regional Centers designated by USCIS based on proposals for promoting economic growth.
Required minimum investments for EB-5 immigrant investor are:
- The minimum qualifying investment in the United States is $1 million.
- Targeted Employment Area (High Unemployment or Rural Area). The minimum qualifying investment either within a high-unemployment area or rural area in the United States is $500,000.

Operational Guidance for EB-5 Cases Involving Tenant-Occupancy

Dear Stakeholders,
In May 2012, USCIS published operational guidance on EB-5 adjudications involving the tenant-occupancy methodology which explains how USCIS policy on deference to prior EB-5 adjudications applies in the context of determinations regarding the reasonableness of an economic methodology. Since this guidance was issued, USCIS has carefully considered responses to Requests for Evidence (RFEs) as well as input from other relevant government agencies and has issued further operational guidance to govern the adjudication of these cases. This guidance will be applied to pending cases involving the tenant-occupancy methodology, as well as cases filed on or after the date of this guidance.

EB-5 Job Creation: Do Construction Jobs Count???
The question of do construction jobs count arises quite often when discussing how the EB-5 program must create U.S. jobs for the usage of the investment through foreign nationals for development projects.
