Highlights of Draft USCIS EB-5 Policy Memorandum

USCIS issued its third draft EB-5 policy memorandum on February 14, 2013.  It is open for public comment through April 1, 2013.
While the draft policy memorandum technically does not establish USCIS binding policy, it is a window into its present thinking on various subjects relating to EB-5 adjudications.
This alert will discuss the highlights of the draft policy memorandum in terms of either new policies or clarifications of previously unclear policies.  It is not meant to be a summary of the entire memorandum, most of which merely restates existing law and policy.
It is important to note initially that the memorandum is not an exhaustive memorandum in that it does not cover most aspects of I-924 adjudications, including adjudications of EB-5 projects.  For example, it makes no reference to use of EB-5 money to pay back bridge financing; whether EB-5 loans can be paid back to a new commercial enterprise before conditions are removed; whether direct employees of the job-creating entity (indirect employees of the new commercial enterprise) must be “qualifying employees”; etc...

E-Verify Receives High Ratings in Customer Survey


Just released today, Director Mayorkas of the USCIS declared that they have received great reviews regarding the free E-Verify Online employee verification that helps United States businesses to verify eligibility to work in the USA. The E-Verify has been praised for its ease of use and customer support.

WASHINGTON—U.S. Citizenship and Immigration Services Director Alejandro Mayorkas today announced that users of E-Verify, the free Internet-based system that allows businesses to determine the eligibility of their employees to work in the United States, have given the program high marks in a recent customer survey.

More than 1,300 randomly selected employers across the nation who use E-Verify evaluated key program aspects, including registration, the online tutorial, ease of use, technical assistance and customer service. They rated the program as exceptionally high in overall customer satisfaction, with an average score of 86 out of 100 on the American Customer Satisfaction Index (ACSI) scale. 

 “We are proud of the advancements we have made in the E-Verify program,” said Director Mayorkas. “This customer survey validates the success of our efforts, which we have undertaken in collaboration with the business and labor communities and other key stakeholders.”

Bonacic Wants Legislative Control Over The State's Casino Locations


More positive news coming out of Albany, New York pertaining to the locations of where the State's Casino's will be located. This is great news for the Rock Hill Town Center project that is sponsored by RH Land and Rock Hill Regional Center (Empire State EB-5). With the bolstering of economic growth in the Upstate New York region, especially with the casinos in mind, this area will be in need of hospitality and commercial real estate which the Rock Hill Town Center will have to offer.

Bonacic said he would ideally like to see three casinos in the Catskills and one at the Aqueduct racino, which produced record revenues last month.The Catskills in 2001 was authorized to have three Indian casinos, but has never been built.

Foreign-investment led projects blossom

While construction lending remains tight and high loan-to-cost ratio continue, the EB-5 Regional Center program offers an alternative financing route for projects, especially if they require new real estate construction. In general, EB-5 financing will cover approximately 20 percent to 70 percent of a project depending on the number of jobs created.
