The Language of Immigration Reform: Saying what people want to hear!!!

 “Americans SUPPORT growing the economy through immigration. They want America to be globally competitive, and they know that a workforce of the world’s best and brightest helps get us there.”

Fully two-thirds of Americans believe that legal immigrants “boost the economy.” They agree with the statement: “In this 21st Century global economy, we must be forward thinking and ahead of the curve. Immigrants bring new ideas, new perspective, and new talent to our workforce. To compete with growing global economic powers like China and India, we need to think globally and recruit the very best from around the world.”

EB-5 Program Rising in Numbers

News from USCIS Stakeholders' Meeting Details Here:

EB-5 Visa numbers are still climbing, with 3706 issued so far this year.  At this pace the program will outdo its previous record set in 2009 from projections for 2011.

I-526 and I-829 filings are WAY up, with rejection rates of I-526s on the high side at 18% (a bit high in our opinion), and I-829s at 7% (lower than any previous report, which is a positive sign).  The proof though, will be in the results of the mass submissions of this year - will the there be enough job creation?

Processing wait times look like they are declining, which, again, is a very productive sign!

USCIS Begins Implementation of Enhancements to the EB-5 Program

(Source: USCIS)

USCIS is implementing the first phase in a series of proposed enhancements to the EB-5 program.  Beginning today, Form I-924 applicants will be able to communicate directly with USCIS adjudicators via e-mail in an effort to streamline the process and quickly raise and resolve issues and questions that arise during the adjudication process.  The Form I-924 is the Application for Regional Center Under the Immigrant Investor Pilot Program.  Information on how direct e-mail communication will work can be found in our Questions and Answers document.
USCIS intends to monitor the progress of this new line of communication to assess whether changes are needed and to implement any required changes on a real-time basis.  If you have feedback in response to your use of the direct line of communication for the Form I-924, please submit your comments to opefeedback@uscis.dhs.gov.
USCIS is eager to implement all of the proposed enhancements to the EB-5 program that it first announced on May 19, 2011. USCIS is currently exploring how it can accelerate the implementation of premium processing, which customarily takes months due to the need to revise the applicable forms.  USCIS is currently hiring economists and other experts that will enhance and accelerate the adjudication process and also help constitute the Decision Board that was first described on May 19.
Implementation of enhancements to the EB-5 program is a high priority for USCIS. Director Alejandro Mayorkas will provide more information about the status of the proposed enhancements and other action items for this program in his first Conversation with the Director this Wednesday, September 14, and in the national stakeholder engagement on Thursday, September 15.

Show me another current project in Western NY which will create this many jobs?

The Comedy Hall of Fame is a current project that Western New York needs, and NEEDS NOW!!! We are working close with potential developers dealing with the fine line issues that need sorting out. Take a look at the potential economic growth figures gathered below to give you an idea of how HUGE this project will be for the Western New York economy and the local community.

Taking 90% of an estimated 440 people that would be hired from the unemployment rolls which is 396 people, then it would translate to a saving for the State in unemployment benefits of $2,574,000 in just 6 months! This is using low salary figures and the state could save $5 Million Dollars in just its first year alone!

More important those 440 people would now have a pay check and be able to spend money. If getting people off the unemployment and back to work is the principal concern for the state and local government then this project achieves all that and more.

The total above is not including the hundreds of economic spin off jobs that will be created in surrounding businesses that result from the Comedy Hall of Fame being located in Western New York.

The Comedy Hall of Fame IS THE ANSWER !!!!!!!!!

Key Points for EB-5 Investors

It is extremely important to choose the right EB-5 project to invest in because the future investment of the green card approval depends on the correct decision making and planning. Each EB-5 investor needs to realize that there are many aspects of the project and must consider a few key points when making a choice.

  1. ·         is the project located in Targeted Employment Area;
  2. ·         what is the percentage EB-5 capital of in the total cost of the project;
  3. ·         what experience does the management team have;
  4. ·         is there any government support and government financing;
  5. ·         how many EB-5 investors the project needs;
  6. ·         how many jobs the project is creating;
  7. ·         what methodology the project uses to calculate the job creation;
  8. ·         what exit strategy the project offers to foreign investors.
