“New York Open for Business” ad campaign and economic development funds totaling $40 million

  
The state of New York has allocated funds to a long term ad campaign, “New York Open for Business.” This, along with the assembly of state funds for economic development through 10 local development councils throughout the state, are the beginnings of the state government attempting to reverse the reputation of New York having one of the worst business climates and create jobs.

In years past, businesses have left the state at a high rate, taking jobs along with them. The new economic development councils will be submitting 5 year strategic plans by November 14th for plans in the five boroughs. Initial ideas emerged centering around leveraging regional assets, focus on quality job creation, improving disadvantaged areas, infrastructure investments and education.

New York City has long been viewed as a global center with an entrepreneurial spirit and will receive $40 million of the total $200 million the state has allocated for these initiatives, geared for small businesses. Stay tuned for new developments.

USCIS Citizenship Public Education and Awareness Initiative Video

The Citizenship Public Education and Awareness Initiative promotes awareness of the rights, responsibilities, and importance of United States citizenship, and the free naturalization preparation resources available to permanent residents and immigrant-serving organizations.
Through this effort, USCIS seeks to:
  • Increase awareness of the rights, responsibilities, and importance of U.S. citizenship.
  • Encourage eligible permanent residents to consider the benefits of U.S. citizenship for themselves and their communities.
  • Increase understanding of the naturalization process and requirements.
  • Increase awareness of available citizenship preparation resources.
  • Educate eligible permanent residents about the steps they can take to apply for citizenship and prepare for the naturalization process.

I just heard that some other Regional Center's are taking a year or more to get green cards for their foreign investors. Really? Serious?

So, who does your work really does matter. I've seen an  application approved in 47 hours!

"Does the United States of America currently have a Citizenship-through-Investment Program?"



The concise answer to this question is: No. Although in the United States, it is not possible to receive Citizenship merely through investing capital therein. However, one could argue that the EB-5 visa is a "path to citizenship by investment." Through participation in the EB-5 Immigrant Investor program the foreign immigrant can receive Lawful Permanent Residence (LPR) if their visa application is approved and they are admitted lawfully to the United States. Once in the "LPR" status the foreign investor may be able to naturalize to American Citizenship upon meeting the eligibility criteria for naturalization and fulfilling the requisite statutory physical presence period as stipulated under the relevant sections of the American Immigration and Nationality Act (INA).

    What is Targeted Employment Area (TEA)?



     A Targeted Employment Area (TEA) is defined by law as “a rural area or an area that has experienced high unemployment of at least 150 percent of the national average.”

    'Rural Area' - means any area not within either a metropolitan statistical area (as designated by the Office of Management and Budget) or the outer boundary of any city or town having a population of 20,000 or more.

    A Targeted Employment Area (TEA) for EB-5 Visa purpose allows $500,000 USD investment rather than the regular $1 Million USD.

    The USCIS Regional Center designation allows the requisite job-creation to be indirect and induced, as well as direct. When you have a Targeted Employment Area within a Regional Center you get a EB-5 project that requires $500,000 USD and allows job-creation to take place through directly and indirectly, but sometimes all indirectly.

    USCIS/DHS Gets Serious About EB-5

    To the ABSOLUTE DELIGHT of the EB-5 Community, on August 2, 2011 Secretary of Homeland Security Janet Napolitano and U.S. Citizenship and Immigration Services (USCIS) Director Alejandro Mayorkas just unveiled a series of policy, operational, and outreach efforts “to fuel the nation's economy and stimulate investment by attracting foreign entrepreneurial talent of exceptional ability or who otherwise can create jobs, form startup companies, and invest capital in areas of high unemployment.” To paraphrase, they’re clued in on the fact that slo-mo timelines mean foreign venture capital (FVC) takes a loooooooong time to get to job-starved U.S. communities.

    I’m linking the Press Release HERE but here are the main points: 

    • For the first time, they gave legit airtime to Startup America, the White House-led initiative to reduce barriers and accelerate growth for America's job-creating entrepreneurs, is being publicized FINALLY. (Hey, if EB-5 attorneys aren’t aware of it, it isn’t an “initiative”.)
    • They talked about the President's Council on Jobs and Competitiveness
    An academically-interesting part of the PR was their clarification that entrepreneurship is now officially a gateway to the National Interest Waiver. While cases like this have certainly been approved, it’s the first time the USG comes out and says it welcomes top tier business veterans to consider the NIW.
    But the stuff everyone is yapping about is the ambitious list of plans USCIS has for improving the EB-5:
    • extending the availability of premium processing for certain EB-5 applications and petitions
    • implementing direct lines of communication between the applicants and USCIS (very welcome but, honestly, they answer when you ask nice (-;)
    • providing applicants with the opportunity for an interview before a USCIS panel of experts to resolve outstanding issues in an application. Way cool.

    But the part of this that is most notable is their statement that USCIS is “poised to begin implementing the first of these enhancements within 30 days.” Wunderbar! 

    Last but not least, they spoke of “launching a new series of engagement opportunities for entrepreneurs and startup companies. These opportunities will focus on soliciting input from stakeholders on how USCIS can address the unique circumstances of entrepreneurs, new businesses and startup companies through its policies and regulations in the employment-based arena.” I’m not sure exactly what this means but this is one seasoned old lawyer who greets all of this with high-fives and “hallelujahs!”.

    USCIS, you have a very supportive EB-5 bar ready to help you pave the road through these positive changes and we are at your service!

    "Comparing Apples to Oranges" - EB-5 Regional Center Visa Program vs. Individual EB-5

    The old saying goes "Comparing apples to oranges" when making a decision on what people want. People look at the positive and negative of two things to determine the best choice. In essence these are choices a foreign investor has when choosing what Visa program to participate in and where to invest their hard earned money. With many foreign investors already busy with their own day to day operations who wants to hassle with "Do It Yourself" Visa programs, when it's as easy as a small investment to turn a frown upside down.

    With many investors interested in living in the U.S. are eager to start a new business, others are concerned that they may not be able to replicate the success they've had back in their home country. In fact, given the current economic climate, even some of those "hands on" entrepreneurs are giving the notion of an upstart business a close re-examination.

    Fortunately, the U.S. government offers an investment-based permanent residency opportunity which takes the traditional investment and job creation requirements of the individual EB-5 Investor Visa and consolidates it into structured, federally-approved "Regional Centers" which essentially offer the same immigration benefits while removing the task of new business creation from the investor.
